Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Packlify platform, available at packlify.com (the "Service"), operated by Packlify ("we", "us", or "our").

Please read these Terms carefully before using the Service. By creating an account or accessing the Service in any way, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By signing in and using Packlify, you confirm that:

• You are at least 18 years of age
• You have the legal authority to enter into these Terms on behalf of yourself or your business
• You agree to comply with these Terms and all applicable laws and regulations

2. Description of Service

Packlify is an AI-powered content creation platform for small businesses. The Service allows you to:

• Configure brand settings including your business identity, voice, tone, and products
• Generate text content such as social media posts, advertisements, email copy, blog outlines, product descriptions, and taglines
• Generate images using AI
• Save, review, and manage your generated content

Content is generated using Google Gemini, a third-party AI service. The quality, accuracy, and uniqueness of AI-generated content cannot be guaranteed. See Section 9 for more details.

3. Account Registration

To use Packlify, you must sign in using a valid Google account. By doing so, you authorise us to retrieve your name, email address, and profile photo from Google for the purpose of creating and managing your Packlify account.

You may hold only one Packlify account per person. Creating multiple accounts to circumvent usage limits, subscription restrictions, or any other policy is prohibited.

You are responsible for keeping your Google account credentials secure. Any activity that occurs under your Packlify account is your responsibility.

4. Subscription and Billing

4.1 Credit System

Packlify operates on a credit-based system. Credits are consumed when you generate AI content. New accounts receive a one-time allocation of free credits upon sign-up. Additional credits are available through monthly subscription plans or one-time top-up credit packs.

Monthly subscription credits are allocated at the start of each billing period and do not roll over to the following month. Top-up credits do not expire and are used after your monthly credit allowance is exhausted.

4.2 Payment Processing

All payments are processed by LemonSqueezy, our third-party payment processor. Packlify does not store your payment card details. By making a purchase, you also agree to LemonSqueezy's terms of service.

Subscription fees are billed in advance on a monthly basis. One-time credit pack purchases are charged at the time of purchase.

4.3 Refund Policy

Due to the nature of digital services and AI-generated content, all purchases are generally non-refundable. However, if you experience a verified technical failure resulting in credits being deducted without content being generated, please contact us at support@packlify.com and we will review the issue in good faith.

Subscription cancellations take effect at the end of the current billing period. You will retain access to your plan benefits until that date. We do not issue pro-rated refunds for unused subscription time.

4.4 Price Changes

We reserve the right to change our pricing at any time. For subscription plans, we will provide at least 14 days' advance notice of price changes, effective from your next renewal date.

5. Acceptable Use

You agree to use Packlify only for lawful purposes and in accordance with these Terms. You must not use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• Generate content that infringes the intellectual property rights of any third party
• Generate or distribute spam, unsolicited communications, or deceptive advertising
• Generate content that impersonates any person or entity, or misrepresents your affiliation with any person or entity
• Produce content involving minors in any inappropriate or illegal context
• Attempt to reverse-engineer, scrape, or extract data from the Service beyond what is provided through the normal user interface
• Resell, sublicense, or otherwise commercially distribute access to the Packlify platform or its underlying AI capabilities to third parties as if it were your own product
• Use the Service in any way that could damage, disable, overburden, or impair our systems or interfere with other users' use of the Service
• Attempt to gain unauthorised access to any part of the Service or its related systems

We reserve the right to review AI-generated content for policy compliance and to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

6.1 Your Content

You retain ownership of the AI-generated content produced through your use of the Service, including text and images you generate using your prompts and brand context. By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing and improving the Service.

You are responsible for ensuring that the content you generate and publish complies with applicable laws and does not infringe any third-party rights.

6.2 The Packlify Platform

The Packlify platform, including its software, design, interface, brand, and technology, is our exclusive property or is licensed to us. Nothing in these Terms grants you any rights to use our name, logo, trademarks, or other proprietary materials. You may not copy, modify, distribute, or create derivative works based on the Packlify platform without our prior written consent.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us an unrestricted, royalty-free licence to use that feedback for any purpose, including incorporating it into the Service, without any obligation to you.

7. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

8. Third-Party Services

The Service relies on third-party services including Google (for authentication, infrastructure, and AI) and LemonSqueezy (for payments). Your use of these third-party services is subject to their own terms and privacy policies.

We are not responsible for the practices, availability, or content of any third-party services. Links to or integrations with third-party services do not constitute our endorsement of those services.

9. AI-Generated Content Disclaimer

Content generated by Packlify is produced by Google Gemini, a large language model AI. By using the AI features of the Service, you acknowledge and agree to the following:

• No guarantee of accuracy. AI-generated content may contain factual errors, outdated information, or inaccuracies. You are solely responsible for reviewing and verifying any content before publishing or distributing it.
• No guarantee of uniqueness. AI models may produce similar or identical outputs for different users. We do not guarantee that content generated through Packlify is unique, and we make no representation that such content is free from claims of similarity to other works.
• Not professional advice. AI-generated content does not constitute legal, financial, medical, or any other form of professional advice. Do not rely on AI-generated content as a substitute for professional consultation.
• Your responsibility. You are responsible for all content you generate, publish, or distribute using the Service. We are not liable for any consequences arising from your use of AI-generated content.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Packlify and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from:

• Your use of or inability to use the Service
• Any AI-generated content produced through the Service
• Unauthorised access to or alteration of your data
• Any third-party conduct or services integrated with Packlify

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of: (a) the amount you paid us in the three months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components, or that any defects will be corrected.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or our policies.

You may terminate your account at any time by contacting us at support@packlify.com. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

We are not liable to you or any third party for termination of your account.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through a notice within the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Israel. If you are a consumer resident of a jurisdiction that grants you mandatory local protections, those protections are not waived by this clause.
